1. Acceptance of These Terms

Welcome to ElfAi Technologies ("we," "us," or "our").

These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, products, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

3. The Service

ElfAi Technologies provides tools and features powered by AI across our products — décorAi, AiMusic, CarAiwon, and related services. Features may include, depending on the product, availability, and your plan:

• interior and exterior design transformation
• music generation
• voice transformation
• voice library access
• cover art generation
• stem separation
• video generation
• automotive diagnostics and community features
• subscriptions, credits, and top-up systems
• other related AI-powered creative features

Some features may be limited by plan, region, availability, technical constraints, or third-party provider restrictions.

We may add, modify, suspend, or remove features at any time.

4. Accounts

You may need to create an account to use certain features.

You are responsible for:

• maintaining the confidentiality of your account credentials
• all activities under your account
• keeping your account information up to date

You must not:

• share your account in an unauthorized way
• impersonate another person or entity
• create accounts using false or misleading information
• attempt to access accounts or systems you are not authorized to use

We may suspend or terminate accounts that violate these Terms or present security, fraud, abuse, or legal risks.

5. Paid Features, Subscriptions, and Credits

Some parts of the Service may require payment, including subscriptions, one-time purchases, top-ups, or credits.

5.1 Subscriptions

If you subscribe to a paid plan:

• billing may be handled by Apple, Google, or other authorized payment providers
• renewals may occur automatically unless canceled according to the provider's rules
• pricing, feature access, and included credits may vary by plan

5.2 Credits

Certain features may consume credits.

Credits:

• are a limited-use product feature within the Service
• are not legal tender or stored monetary value
• are not transferable unless we explicitly allow it
• may expire or be limited based on the applicable plan, promotion, or product rules
• may differ between subscription credits, top-up credits, or promotional credits

We may update credit usage rules, consumption rates, or feature pricing at any time.

5.3 Refunds

Refunds, cancellations, billing disputes, and subscription management may be subject to:

• the rules of the relevant app store or payment provider
• applicable law
• our internal fraud, abuse, and operational policies

Unless required by law or expressly stated otherwise, unused credits may be non-refundable.

6. Your Content

You may provide input to the Service, including prompts, uploaded files, audio, images, text, and other materials ("Your Content").

You retain ownership of Your Content, subject to the rights you grant below.

By using the Service, you grant us and our service providers a limited, non-exclusive, worldwide license to host, store, process, reproduce, modify, transmit, transform, display, and use Your Content only as reasonably necessary to:

• provide requested outputs
• maintain security and abuse prevention
• troubleshoot, support, and improve reliability
• comply with legal obligations

You represent and warrant that:

• you have all rights necessary to submit Your Content

• you have obtained any permissions, licenses, or consents required for uploaded voices, likenesses, music, media, or other protected material

7. Generated Content

The Service may generate outputs such as songs, voices, images, cover art, videos, stems, and related media ("Generated Content").

Subject to these Terms, your subscription or feature limits, and any third-party provider restrictions, you may use the Generated Content made for your account.

However:

• Generated Content may not be unique
• similar or identical outputs may be generated for other users
• Generated Content may contain errors, inaccuracies, artifacts, or other limitations
• you are solely responsible for reviewing Generated Content before publishing, distributing, or using it commercially
• you are solely responsible for ensuring your use of Generated Content complies with applicable law and does not violate third-party rights

We do not guarantee that Generated Content is copyrightable, exclusive, non-infringing, merchantable, or fit for any particular purpose.

8. Voice, Image, and Likeness Responsibility

If you upload:

• your voice
• another person's voice
• your face or image
• another person's likeness
• any media containing identifiable individuals

you are solely responsible for ensuring you have the legal right and any required consent to do so.

You must not use the Service to:

• impersonate others unlawfully
• mislead users about identity or endorsement
• violate privacy, publicity, or personality rights
• create fraudulent, defamatory, abusive, or deceptive content

9. Acceptable Use

You agree not to use the Service to:

• violate any law or regulation
• infringe intellectual property, privacy, publicity, or contractual rights
• upload malicious code, viruses, or harmful files
• scrape, reverse engineer, disrupt, or overload the Service
• interfere with accounts, systems, APIs, queues, or infrastructure
• bypass credit, plan, billing, or access restrictions
• create or distribute harmful, abusive, fraudulent, hateful, sexually exploitative, or otherwise prohibited content
• engage in spam, automated abuse, or denial-of-service behavior
• use the Service in a way that creates unreasonable operational burden or security risk

We may investigate, restrict, suspend, remove, or terminate access if we believe your use violates these Terms or creates risk to us, our users, or third parties.

10. Moderation and Enforcement

• enforce plan and credit rules
• investigate fraud or misuse

We are not obligated to monitor all content, but we may do so where reasonably necessary.

• policy changes by third parties
• output limitations imposed by providers
• billing, restrictions, or service interruptions caused by third-party systems

Your use of some features may also be subject to the separate terms and policies of third-party providers.

13. Availability and Changes

We do not guarantee that the Service or any feature will always be available, uninterrupted, error-free, or compatible with every device or region.

We may:

• update the Service
• change pricing or credits
• add or remove features
• impose usage limits
• discontinue part of the Service

at any time.

14. Termination

You may stop using the Service at any time.

We may suspend or terminate your access, with or without notice, if:

• you violate these Terms
• we suspect fraud, abuse, or unauthorized activity
• required by law or app store/provider rules
• your use creates security, legal, or operational risk

After termination:

• your right to use the Service ends
• some data may remain for legal, accounting, security, dispute-resolution, or backup reasons
• provisions that by nature should survive termination will survive

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• TITLE
• ACCURACY
• RELIABILITY
• AVAILABILITY
• SECURITY
• ERROR-FREE OPERATION

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ElfAi Technologies, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

• THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR
• USD $100

17. Indemnification

You agree to defend, indemnify, and hold harmless ElfAi Technologies from and against any claims, liabilities, damages, losses, and expenses arising out of or related to:

• Your Content
• your use of the Service
• your Generated Content
• your violation of these Terms
• your violation of any law or third-party rights

18. Privacy

Your use of the Service is also governed by our Privacy Policy.

19. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Istanbul, Turkey, unless applicable law requires otherwise.

20. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may update the "Last updated" date and, where appropriate, provide additional notice.

Your continued use of the Service after the updated Terms become effective means you accept the revised Terms.
