1. Acceptance of Terms

By accessing or using the AiMusic mobile application ("App") and related services ("Services"), provided by ElfAi Technologies LTD ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

AiMusic is an AI-powered music creation platform that enables users to:

• Generate original songs using artificial intelligence
• Create music videos synchronized to generated tracks
• Apply voice transformations and vocal styling
• Access professional audio production tools
• Preview vocal performances using text-to-voice synthesis

3. Account Registration

To use certain features of the App, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 13 years of age to use the App. By creating an account, you represent and warrant that you meet this age requirement.

4. Credits and Payment

The App uses a credit-based system for content generation. Credits can be obtained through:

• Free tier: Limited credits provided upon registration
• Subscription plans: Monthly or annual subscriptions that provide recurring credits and additional benefits
• Top-up packages: One-time credit purchases for additional usage

All purchases are processed through Apple's In-App Purchase system (iOS) or Google Play Billing (Android). Subscription management, renewals, cancellations, and refunds are governed by the respective platform's policies. You may manage your subscriptions through your device settings.

5. Intellectual Property and Content Ownership

Your Content: You retain ownership of the text prompts, lyrics, and creative inputs you provide to the App.

Generated Content: Content generated by the AI (songs, videos, voice transforms) is licensed to you for personal and commercial use, subject to the limitations of your subscription tier.

Our Content: The App, its design, branding, underlying technology, and proprietary systems remain the exclusive property of ElfAi Technologies LTD. You may not copy, modify, distribute, or reverse-engineer any part of the App.

6. Acceptable Use

You agree not to use the App to:

• Generate content that is illegal, harmful, threatening, abusive, or harassing
• Create content that infringes on the intellectual property rights of others
• Impersonate any person or entity
• Attempt to reverse-engineer, decompile, or disassemble the App or its underlying systems
• Use automated systems, bots, or scripts to access the App beyond normal usage
• Generate content depicting or promoting violence, hate speech, discrimination, or any illegal activity

7. Content Moderation

We reserve the right to review, moderate, and remove any content that violates these Terms or our content policies. We may suspend or terminate accounts that repeatedly violate our policies without prior notice.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that generated content will meet your specific requirements or expectations. AI-generated content may occasionally produce unexpected or imperfect results.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ElfAi Technologies LTD, its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Continued use of the App after such modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

12. Termination

We may terminate or suspend your account and access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the App ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ElfAi Technologies LTD is registered, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
